R~SOLUTION NO. 894
A RESOLUTION EXCLUDING ANNEXED PROPERTIES FROM
THE CHERRYVALE FIRE PROTECTION DISTRICT.
WHEREAS, the City of Boulder has annexed certain territory, which territory was formerly
provided with fire protection by the Cherryvale Fire Protection District ("DistricY'); and
WHEREAS, the City can provide fire protection to Yhat territory; and
WHEREAS, the City is presently providing such protection, and has done so since each
parcel was annexed; and
WHEREAS, the District will noY be harmed by exclusion of that territory from its
jurisdiction; and
WHEREAS, the owners of that territory will be harmed by paying property taxes to both Yhe
City and the District for the same fire protection services.
NOW, THEREFORE, be it resolved by the City Council ofthe City ofBoulder, that fhe City
of Boulder, Colorado, provide fire protection service to the territory specified in Exhibit A, which
service had been provided by the Cherryvale Fire Protection District. Because this protection is
already being provided, this resolution will necessarily be, and continue to be, effective on Januaty
1, 2002,
ADOPTED this 4°i day of December, 2001.
