RESOLUTION NO. s64
A RESOLUTION TO DETERMINE THAT THE PETITION TO
ANNEX A 37, 898 SQUARE FOOT PARCEL OF LAND LOCATED
AT 2810 JAY ROAD IS IN COMPLIANCE WITH SECTION
31-12-107(1), C.R.S. AND TO SET A HEARING TO DETERMINE
COMPLIANCE WITH OTHER STATUTORY ANNEXATION
REQUII2EMENTS.
WHEREAS, the City Council of the City ofBouider, Colorado, hereby finds that the Petition
to Annex the property more particularly described in Exhibit A, attached hereto and incorporated
herein by reference, is in compliance with subsection 31-12-107(1), C.R.S., as amended;
WHEREAS, the City Council of the City of Boulder, Colorado, finds that the following
requirements have been met:
a. Landowners of more than fifty percent of the area, excluding public streets and
alleys, meeting the requirements of Sections 31-12-104 and 31-12-105, C.R.S., as
amended, have petitioned the City of Boulder for annexation of such territory;
b. The Petition has been filed with the City Clerk;
c. The Petition alleges it is desirable and necessary that such area be annexed to the City
of Boulder;
d. The Petition alleges that the requirements of Sections 31-12-104 and 31-12-105,
C.R.S., as amended, exist or have been met;
e. The Petition contains a request that the City of Boulder approve the annexation ofthe
area proposed to be annexed;
£ The Petition alleges that signers ofthe Petition comprise the landowners ofmare than
fifty percent of the territory included in the area proposed to be annexed, exclusive
of streets and alleys;
g. The Petition contains signahires of such landowners;
h. The Petition contains the mailing address of each signer;

The Petition contains the date of signing of each signature;
k. The Petition contains the affidavit of each circulator of such Petition, that each
signature therein is the signature of the person whose name it purports to be; and
WHEREAS, four copies of an annexation map accompanied the Petition and contained the
following information:
a. A written legal description of the boundaries of the area proposed to be annexed;
b. A map showing the boundary of the area proposed to be annexed;
c. Within the annexation boundary map, a showing of the location of each ownership
tract in unplatted land and, if part or all of the area is platted, the boundaries and the
plat numbers of plots or of lots and blocks;
d. A drawing of the contiguous boundary of the City of Boulder next to the boundary
of the area proposed to be annexed and the contiguous boundary of any other
municipality abutting the area proposed to be annexed.
WHEREAS, all signatures on the Petition have been dated no more than one hundred eighty
days prior to the date of filing the Petition with the City Clerk;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BOULDER, COLORADO, THAT:
A hearing will be held to determine whether the requirements delineated in Sections
31-12-104 and 31-12-105, C.R.S., as amended, have been met and whether an election is required
under subsection 31-12-107(2), C.R.S. The hearing will be held at 6 p.m. on December 19, 2000,
at 1777 Broadway, Boulder, Colorado.

A tract of land .in the NWk of the SMk of Section 17, T1N, R70w of the
6th P.M., County of Boulder, State of Colorado, described ns follows:
Cornnencing at the NE Corner of the NWk of the SW~f of said Seetlon 17,
thence S 89°33' w, 133.23 feet along the North line of the NW1~ of the
SWh of said Section 17 to the NW Corner of that tract of lend des-
cribed in deed recorded in Sook 1111 at Page 291 of the Boulder County
kecorda, Colorado; Thence S 0°23'30" E, 22,13 feet parellel to the
East line of the NW1{ of the SW1~ of said Section 17, to a point nn the
South sight-of-urey line of Jay Road, said point being the TRUE POINT
OF BEGINNING;
Thence S 0°23'30" E, 304.82 feet oarallel to the Eest line of the NWk
of the SWK of said Section 17;
Thence S 88'21'45" W, 68.41 feet to the SE Corner of that tract of
lard described in deed recorded in Book 1030 at Page 82 of snid Boulder
Cavnty Records;
Thence tortherly, 222.6 feet alorr, the Easterly line of said tract of
land described in deed recorded in Book 1030 at Page 82 to the south-
erly most corner of that tract of land described as Parcel No, lA on
Film 996 as Reception t+o. 264461 of said Boulder County Records, said
Easterly line being a curve to the left with a radius of 2925 feet and
a chord bearing N 26°14'40" W, 222,55 feet;
Thence N i5°50'15" E, 71.00 feet along the Easterly line of aaid tract
of land described na Parcel No. lA, to the northerly most corner
thereof, said northerly most wrner being a point on the Easterly line
of said tract of land described in deed recorded in Book 1030 at Pege
82;
Thence N 60°35'30" E, 86.40 Poet along the Easterly line of said tract
of land described in deed recorded in Book 1030 at Page 82, to a point
on the South right-of-way line of Jay Roed;
Thence S 87°04'15" E, 70.15 feet along the South right-of-way line of
Jay Roed to the TRUE POINT OF BEGINNING.
