RESOLUTION NO. 858
A RESOLUTION DECLARING APPLICATION TYPES THAT
CONSTITUTE A "VALID DEVELOPMENT APPLICATION,"
FOR THE PURPOSE OF PREPARING FOR THE
IMPLEMENTATION OF INITIATIVE #256, "CITIZEN
MANAGEMENT OF GROWTH," AND SETTING FORTH
DETAILS IN RELATION THERETO.
WHEREAS, the City Council of the City of Boulder, Colorado, finds and recites the
following:
A. A citizen group has circulated an initiative petition to amend the Colorado
Constitution entitled "Citizen Management of Growth," also known as Initiative
#256 ("Initiative #256" ).
B. The City Council anticipates Yhat the requisite number of signatures will be collected
to make Initiative #256 eligible for the November 7, 2000 state-wide general
election.
C. Initiative #256 defines the term "valid development applicaYion" as"an application
that substantively meets all the rules for submission applicable to a proposal and that
has been accepted as timely and complete by the local government regulating the use
of the land covered by the application."
D. The City Council intends to further declare what it considers to be a"valid
development application" under the Boulder Revised Code.
NOW, THEREFORE, be it resolved by the City Council of the City of Boulder, Colorado,
that:
1. The City Council deciares that the City will consider the following types of
applications as "valid development applications" to permit applicants and property
owners to continue to have their applications and subsequent filings proceed to the
point in which said applicant or owner will be eligible to apply for building permits
and for the purposes of implementing Initiative #256, "Citizens Management of
Growth."
A. Petitions for annexation pursuant to Section 9-2-5, B.R.C. 1981.

B. Administrative reviews pursuant to Chapter 9-3.5, B.R.C. 1981.
C. Use review applications pursuant to Section 9-4-9, B.R.C. 1981.
D. Concept review applications pursuant to Section 9-4-1 Q B.R.C. 1981.
E. Applications for site review pursuant to Section 9-4-11, B.R.C. 1981.
F. Applications for subdivisions pursuant to Chapter 9-5, B.R.C. 1981.
2. The City Council intends that this resolution be used to carry out the intent of the
voters should Initiative #256 pass with regard to determining the extent of
"committed area"asset forth in Section 2(2)(b), which states ".. a valid
development application as to such land, the approval of which would result in
development that shall be served by central water and sewer services, has been
submitted to the appropriate local government, as of the date on which the 2000
general election ballot was certified by the Colorado Secretary of State," and Section
2(8), which is the definition fora "valid development application," noted in Section
1.C. above.
