A RESOLUTION CONCERNING HOLDING A REFERENDUM
ON THE QUESTION OF WHETHER ELIGIBLE POSITIONS
SHOULD BE INCLUDED UNDER A"MEDICARE-ONLY"
COVERAGE PLAN.
WHEREAS, it is the express purpose and intent of the City Council of the City of Boulder,
Colorado, to extend to its employees the opportunity to participate in the Medicare Program on as
broad a basis as is permitted under applicable State and Federal Law; and
WHEREAS, Section 24-53-101, etseq., C.R.S., and Section 218 ofthe U.S. Social Security
Act (42 U.S.C. 418) provide for the governing body of a political subdivision of the State whose
employees perform services in positions covered by an existing retirement system established by the
State, to request a referendum election to be held by such political subdivision, in this instance to
allow the eligible employees to vote on participation in the "Medicare-Only" portion of the Federal
Insurance Contribution Act (FICA) ta~; and
WHEREAS, "eligible employees" are those employees hired prior to April 1, 1986, who
have been in continuous employment with the City of Boulder, are currently members of the
employer-provided retirement system, PERA and ICMA-RC, and are currently not covered for full
Social Security; and
WHEREAS, many of the employees of the City of Boulder are performing services in
positions covered by the PERA and ICMA-RC.
NOW, THEREFORE, be it resolved by the City Council of the City of Boulder, Colorado
that the City of Boulder is hereby authorized to pursue and hold a referendum on the question of
whether eligible positions covered by the PERA and ICMA-RC should be included under a
"Medicare-Only" coverage plan submitted by such political subdivision.
