WHEREAS, the City of Boulder depends on the revenue generated by the collection of
sales tax to provide services to the citizens of Boulder; and
WHEREAS, the requirement that sales taxes be collected, on purchases from retailers
located within or delivered to addresses in the City of Boulder, has been self-imposed by
citizens, via affirmative votes at elections, to support services desired by such citizens; and
WHEREAS, in order to continue to provide quality public safety, transportation, open
space, library, recreation and other services the citizens of Boulder desire and rely upon, it is
necessary for the continued collection of the revenues generated by the sales and use tax; and
WHEREAS, the prohibition of the collection of sales tax on Internet transactions would
severely hinder the provision of services to the citizens of the City of Boulder; and
WHEREAS, the purchasing of goods over the Internet is expected to expand
dramatically in the future; and
WHEREAS, loca] stores are required by law to collect sales tax on transactions within
their businesses and the prohibition of the collection of sales tax on Internet transactions is
unfair to the local retailers who do business in the City of Boulder; and
WHEREAS, the Congress of the United States of America should not create a
privileged class of business by exempting Internet companies from collecting legally due sales
tax at the expense of local retailers; and
WHEREAS, the collection of sales tax on goods sold over the Internet is not a new tax
but the ability for cities and states to collect taxes on goods purchased by the residents of their
city or state who are constituents expecting the city and state to provide the services paid for
by the dollars generated from the collection of sales taxes.
NOW THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE
CITY OF BOULDER, COLORADO HEREBY EXPRESSES THE CITY OF BOULDER
COLORADO'S STRONG OPPOSITION TO ANY FEDERAL LEGISLATION THAT
