A RESOLUTION EXCLUDING AN ANNEXED PROPERTY FROM
THE CHERRYVALE FIRE PROTECTION DISTRICT.
WHEREAS, the City of Boulder has annexed certain territory, which territory was formerly
provided with fire protection by the Cherryvale Fire Protection District ("DistricY');
WHEREAS, the City can provide fire protection to that territory;
WHEREAS, the City is presently providing such protection, and has done so since the parcel
was annexed;
WHEREAS, the District will not be hanned by exclusion of that territory from its jurisdiction;
and
WHEREAS, the owner of that territory will be hanned by paying property t~es to both the
City and tt~e District for the same fue protection services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BOULDER, COLORADq that:
Section 1. T'he City of Boulder, Colorado, will provide fire protection service to the territory
specified in Exhibit A, which service had previously been provided by the Cherryvale Fire Protection
District. Because this protection is already being provided, this resolution will necessarily be, and
continue to be, effective on January l, 2006.
