A RESOLUTION EXCLUDING ANNEXED PROPERTIES
FROM THE CHERRYVALE FIRE PROTECTION DISTRICT.
WHEREAS, the City of Boulder has annexed certain territory, which territory was
formerly provided with fire protection by the Cherryvale Fire Protection District ("District");
WHEREAS, the City can provide fire protection to that territory;
WHEREAS, the City is presently providing such protection, and has done so since each
parcel was annexed;
~ WHEREAS, ~the District will not be ~harmed by exclusion of ~that territory from its
jurisdiction; and
WHEREAS, the owners of that territory will be harmed by paying property taxes to both
the City and the District for the same fire protection services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF BOULDER, COLORADO, that:
Section 1. The City of Boulder, Colorado, will provide fire protection service to the
territory specified in Exhibit A, which service had previously been provided by the Cherryvale
Fire Protection District. Because this protection is already being provided, this resolution will
necessarily be, and continue to be, effective on January l, 2005.
