A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER
INTO AN INTERGOVERNMENTAL AGREEMENT ACCEPTING THE
TRANSFER OF OWNERSHIP OF BROADWAY (COLORADO STATE
HIGHWAY '~ FROM CANYON BOULEVARD NORTH TO U.S. 36
FROM THE STATE OF COLORADO TO THE CITY OF BOULDER
WHEREAS, Broadway from Canyon Boulevard north to U.S. 36 is an element of the Colorado
State Highway system designated as State Highway 7; and
WHEREAS, the control of the operation of state highways is govemed by the standards and
practice of the Colorado Department of Transportahon (CDOT), includmg decisions related to
basic operatron, street configurahon, traffic control, speed hmrts and access; and
WHEREAS, the North Boulder Subcommunrty Plan was adopted by City Council on August 29,
1995;and
WHEREAS, the North Boulder Subcommwuty Plan sets forth the official vision for the future of
the North Boulder Subcommumty includtng the long-term development and preservation of
North Boulder; and
WHEREAS, the North Boulder Subcommumty Plan idenhfied the need to create a different
character for Broadway through the town center located m the area of the Yarmouth and
Broadway mtersection mcludmg a lower speed, a more pedestnan, bike and transit fnendly
environment with on-street pazkmg, building sited to the street, and mtegrated mto a grid system
of local streets; and
WHEREAS, efforts undertaken wrth CDOT to implement this type of street character for
Broadway did not accommodate these goals includmg the prov~sion of on-street parking and the
reduchon m speed hmit, and
WHEREAS, as an alternatrve CDOT has agreed to abandon ownership of that sectron of
Broadway to the City of Boulder and has agreed to provide the city $2 25 mtlhon to upgrade the
street to crty standards, and
WHEREAS, the city agrees to accept ownership of that sectron of Broadway from CDOT and
manage and maintam this sechon of Broadway m perpeturty.
NOW THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY
OF BOULDER, COLORADO HEREBY AUTHORIZES THE CITY MANAGER TO
ENTER INTO AN INTERGOVERNMENTAL AGREEMENT ACCEPTING THE
TRANSFER OF OWNERSHIP OF BROADWAY (COLORADO STATE HIGHWAY '~
FROM CANYON BOULEVARD NORTH TO U.S. 36 FROM CDOT TO CITY
OWNERSHIP.
