A RESOLUTION TO DETERMINE THAT THE PETITION TO ANNEX
APPROXiMATELY 16 70 ACRES OF LAND GENERALLY LOCATED AT 4195
47`h STREET IS IN COMPLIANCE WITH SECTION 31-12-107(1), C.R.S AND
TO SET A HEARING TO DETERMINE COMPLIANCE WITH OTHER
STATUTORY ANNEXATION REQUIREMENTS.
WHEREAS, the Crty Council of the Crty of Bouldcr, Colorado, hcreby finds that the Pehhon
to Annex the property more panc~ularly descnbed m Exhibit A, attached hereto and mcorporated
herem by reference, is m compl~ance with subsechon 31-12-107(1), C.R.S , as amended,
WHEREAS, the Crty Council of the City of Boulder, Colorado, finds that the followmg
requirements have been met
Landowners of more than fifty peicent of the area, excluding public streets and
alleys, meetmg the requirements of Sect~ons 31-12-104 and 31-12-105, C.R S., as
amended, have pehhoned the Crty of Boulder for annexation of such territory,
The Petrtion has been filed with the City Clerk,
The Petition alleges it is desuable and necessary that such areabe annexed to the Crty
of Boulcler,
d The Petition alleges that the requirements of Sechons 31-12-104 and 31-12-105,
C.R.S , as amended, exist or have been met,
The Pehtion contams a request that the City of Boulder approve the annexahon ofthe
area proposed to be annexed,
The Petihon alleges that signers of Uie Pehhon comprise the landowners ofmore than
fifty percent of the terntory mcluded m the area proposed to be annexed, exclusive of
streets and alleys,
The Petihon contams signatures of such landowners;
The Petttion contams the mailmg address of each signer;
The Petrtion contams the legal descriphon of the land owned by each signer;
The Pehhon contams the date of signmg of each signature,

k The Petition contains the affidavit of each circulator of such Petition, that each
signature therein is the signature of the person whose name rt purports to be, and
WHEREAS, four coptes of an annexation map accompanied the Petition and contained the
following mfonnation
A written legal description of the boundaries of the area proposed to be annexed;
b A map showing the boundary of the area proposed to be annexed,
Within the annexation boundary map, a showing of the location of each ownership
tract m unplatted land and, if part or all of the area is platted, the boundaries and the
plat numbers of plots or of lots and blocks,
A drawing ofthe contiguous boundary of the City of Boulder next to the boundary of
the area proposed to be annexed and the contiguous boundary of any other
municipality abutting the area proposed to be annexed
WHEREAS, all signatures on the Petition have been dated no more than one hundred eighty
days prior to the date of filing the Petition with the City Clerk,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BOULDER, COLORADO, THAT
A hearing will be held to determine whether the requirements delineated m Sections
31-12-104 and 31-12-105, C.R S , as amended, have been met and whether an election is required
under subsection 31-12-107(2), C R.S. The hearing will be held at 6 p.m. on March 16, 2004, at
1777 Broadway, Boulder, Colorado.
