A RESOLUTION TO DETERMINE THAT THE PETITION TO ANNEX
APPROXIMATELY 22 652 ACRES OF LAND GENERALLY LOCATED AT
3035 & 3345 KALMIA, IS IN COMPLIANCE WITH SECTION 31-12-107(1),
C R.S. AND TO SET A HEARING TO DETERMINE COMPLIANCE WITH
OTHER STATUTORY ANNEXATION REQUIREMENTS
WHEREAS, the Crty Council of the Crty of Boulder, Colorado, hereby finds that the Petition
to Annex the property more particularly described m Exhibrt A, attached hereto and mcorporated
herem by reference, is m comphance with subsechon 31-12-107(1), C R S., as amended,
WHEREAS, the City Council of the City of Boulder, Colorado, finds that the followmg
requirements have been met.
a. Landowners of more than fifty percent of the area, excludmg public streets and
alleys, meetmg the requirements of Sections 31-12-104 and 31-12-105, C.R.S., as
amended, have pehtioned the Crty of Boulder for annexation of such territory,
b. The Petition has been filed with the City Clerk,
c. The Petition alleges rt is desirable and necessary that such area be annexed to the City
of Boulder,
d The Petihon alleges that the requirements of Sections 31-12-104 and 31-12-105,
C.R.S , as amended, exist ar have been met,
e. The Petition contams a request that the Crty of Boulder approve the annexahon of the
area proposed to be annexed,
f The Petition alleges that signers of the Petrtion comprise the landowners ofmore than
fifty percent of the temtory included m the area proposed to be annexed, exclusive of
streets and alleys;
g The Petition contains signatures of such laudowners;
h The Pehtion contams the mailmg address of each signer,
The Petition contams the legal description of the land owned by each signer,

k The Petition contains the affidavit of each circulator of such Petttron, that each
signahire therein is the signature of the person whose name it purports to be, and
WHEREAS, four copies of an annexation map accompanied the Petition and contained the
following information.
a. A written legal description of ilia boundaries of the area proposed to be annexed;
A map showing the boundary of the area proposed to be annexed;
Within the annexation boundary map, a showing of the location of each ownership
tract in unplatted land and, if part or all of the area is platted, the boundaries and the
plat numbers of plots or of lots and blocks,
d A drawing of the contiguous boundary of the City of Boulder next to the boundary of
the area proposed to be annexed and the contiguous boundary of any other
municipality abutting the area proposed to be annexed.
WHEREAS, all signatures on the Petition have been dated no more than one hundred eighty
days prior to the date of filing the Petition with the City Clerk;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BOULDER,COLORADO,THAT.
A hearing will be held to determine whether the requirements delineated m Sections
31-12-104 and 31-12-105, C R S , as amended, have been met and whether an election is required
under subsection 31-12-107(2), C R.5 The hearing will be held at 6 p m on March 16, 2004, at
1777 Broadway, Boulder, Colorado
