A RESOLUTION CONCERNING THE PROTECTION OF THE FEDERAL LABORATORIES
AND THEIR PERSONNEL FROM TERRORIST THREATS IN THE CITY OF BOULDER
WHEREAS, the National Occamc and Atmosphenc Admmisliatlon (NOAA) and the NaLional
Institute of Standards and Technology (NIST) employ over 1,500 m their ]aboratoiies m Boulder,
WI3EREAS, a Umversrty of Colorado study estimates the Fedeial Labaratones will
conriibute $340 milliom m ~el economic beneht to Che Crty of Boulder hom 2001-2005,
includmg $57 milhon m 2001 alone;
WHEREAS, the City of Boulder and the Department of Commeice signed a
Memorandum ot Agreement (MOA) m May 1998, the purpose of which is to preserve patt of thc
undeveloped atea through acquisition of a conservanon easement by the Crty lo serve as a buffei
zone aiound the developed area, provide contmumg public access, and exdude some areas from
developmenC;
WHEREAS, the City of Boulder and the Department of Commerce concluded an
Iirevocable Easement m May 1998, conveymg an easement Co the City Co mamtam a buffer zone
consistmg of undeveloped space atound a poriion ot the Fede~al Laboiatories,
WHEREAS, the City of Boulder and Nahve Amei ican Tribes signed a Memoiandum ot
Understandmg m March 1999 regarding mutual mteiest m the lands under the easement,
WHEREAS, the tragic events ot the Oklahoma City bombing of the Alfied P Murrah
Federal Buildmg, and the teiYOrist attacks on the Woild Trade Center m New York and the
Pentagon m Washmgton, D.C., demonstrate the potential for and vulnerab~hty to terronsm wrthm
the United SCates, and panc~ularly at federal facilities,
WHEREAS, the Department of Commerce has mdicated a desire to build a fence atound
the Fede~ al Laborato~ ies m Boulder m order Co mitigaCe the threaC of poss~ble terionst aCtacks at
that srte,
NOW, THEREFORE, BE IT RESOLVED
The City of Boulder recognizes the significant importance of the Federal Laboratories to our community,
and to our nation, and, consistent with the CounciPs adopted leg~slative agenda, supports
contmued tundmg for the Federal Laboratoues located m Boulde~ .
The City of Boulder shall work cooperatively with the Federal Laboratories and the Department of
Commerce to assist, to the degrec poss~ble, m protectmg the Federal Laborato>>es' employees ~tnd
property in Boulder from threats posed by tenonsts
In cases where mitigative actions are contemplated on lands under the aforementioned agreements, the
City of Boulder shall engage the Federal Laboratories and the DeparCment of Commerce m a
collaboratrve manner consistent with the MOA and the Irrevocable Easement, to understand any
perceived threats and mutually agree upon appropriate mrtrgahve actions
In cases where mitigative actions are contemplated on lands under the aforementioned agreements,
the City of Boulder shall make every efforC to $nd a solution that preserves the full integrity of
the agreements, and shall only consrder actrons inconsrstent or detrimental to the agreements,
such as the constructron of a fence, after other alternatrves are determined to be mfeasrble or
meffecnve.
