10-28 Item VI-E C I T Y O F B O U L D E R PARKS AND RECREATION ADVISORY BOARD AGENDA ITEM MEETING DATE: October 28, 2013 AGENDA TITLE : Smoking Ban on the Municipal Campus and Parkland PRESENTERS: Kirk Kincannon, CPRP, Director, Parks and Recreation Jeff Dillon, Parks and Planning Superintendent Alice Guthrie, Recreation Superintendent Abbie Poniatowski, Senior Business Services Manager EXECUTIVE SUMMARY: On June 11, 2013, during the 2013 Work Plan update with city staff, City Council asked that a smoking ban on park lands, the municipal campus area as well as other civic areas, be brought back for discussion by City Council in the fourth quarter of 2013. As a result, the Department of Parks and Recreation is seeking PRAB input on a smoking ban that applies to the municipal campus area and all city parks. Input from the city attorney has indicated that a city manager rule might be the initial course of action for consideration by City Council related to the smoking ban on the municipal campus and parkland and that a more detailed discussion and consideration would occur with council related to park smoking ban in early 2014. PRAB is being asked to provide their thoughts and input on a municipal campus smoking ban and a smoking ban on city parkland that is managed by the Parks and Recreation Department. The PRAB discussion and comments will be provided to the city manager and City Council when the issue is taken up by City Council in the fourth quarter of 2013. ANALYSIS: On December 18, 2012 City Council passed an ordinance to ban smoking on Pearl Street Mall, No.7881 section 6-4-5.5 BRC 1981. Since the implementation and enforcement of the ordinance began this spring, approximately 80 violations have cited by police officers on the mall area. Anecdotal evidence indicates that the smoking ban on Pearl Street has helped influence a reduction of smoking on the Pearl Street Mall. During the Pearl Street Mall smoking ban discussion, City Council made notice that consideration should be given to a much larger smoking ban review related to city parkland and public areas.
