As noted at the PRAB meeting of March 18, 2013, conditions have changed since the initial approvals by the PRAB and City Arts Commission in 2008. This includes a new interim art policy which requires the establishment of a public art selection panel and recently after an examination of underground site conditions, the discovery of underground utilities that will require that a new site be selected. The process will be undertaken within the guidelines of the current interim art policy. This information was conveyed to the artist representatives at a meeting on August 20, 2013. The artist will work to identify potential new sites within the North Boulder Park that meet the artist intent and that also meets the BPRD site criteria to minimize impacts to existing park use. ANALYSIS: The purpose of this memo is to provide a brief update on the proposed sculpture, the Boulder Cycling Monument (BCM), in North Boulder Park. Given the time lapse since initial approval by PRAB in December of 2008 and by the Boulder Arts Commission in November 2008 several conditions have changed and new information that will require additional action. This includes: The city adopted a new Arts Policy, effective August 1, 2011 that supersedes the BPRD Art Policy that was in place at the time of the selection of the art. AGENDA ITEM #VI-A_Page | 1 In review of new improvements to North Boulder Park it was discovered that the artist’s structural engineer failed to identify sub surface site conditions. The new site work has identified three major public utilities (8 inch VCP sanitary line, 18 inch VCP drainage line, and an 8 inch water line) directly below the selected location of the public art. Based on this information the department met with the artist representatives and reviewed the site conditions and discussed the next steps to move forward. The actions include: 1.Establish an art selection panel per the current art policy section VI-D-1 Public Art Selection Panel. This requires a panel established by the Library/Arts Director to include a member of the Arts Commission, an independent artist, an arts professional/educator, a representative of BPRD and one community and /or neighbourhood member or facility user. I also recommend that one member of PRAB be represented on this panel. 2.The BPRD will provide a set of site criteria that will identify areas of public use that should not be considered for placement of art so as to limit conflicts with existing park use. 3.Conduct a community meeting with notification to residents living around the park at a future PRAB meeting. The purpose is to take public comment on the new proposed location(s) to help form the panel’s final recommendations. 4.Prepare a contract with the artist to address all legal and financial obligations outlined in the art policy. In addition it is BPRD recommendation that a time specific date should be established for the funding efforts. The recommendation is for a one year to achieve 100% funding completion from the date of final approval by the City. 5.Follow the procedures with the current interim arts policy, once a suitable site has been selected. This includes: a.Panel review and recommendation b.Review by the Arts Commission and by PRAB c.Decision by the City Manager ATTACHMENTS: A.Interim Policy on Public Arts, dated August 1, 2011 B.Boulder Arts Commission letter dated July 8, 2013 C.PRAB public hearing memo dated December 15, 2008 D.Site map showing utilities and proposed art location AGENDA ITEM #VI-A_Page | 2
