Staff requests council consideration of this matter and action in the form of the following
motion:
Motion to approve a resolution finding the annexation petition in compliance with state
statutes and abandoning September 1, 2009 as the date for final action and establishing
October 6, 2009 as the date for final action for the annexation request.
EXECUTIVE SUMMARY:
The City Council is requested to annex the fifteen properties in the northern part of the
city as described in the title into the city using the annexation by petition procedures
established in the Municipal Annexation Act of 1965 (Section 31-12-101 et seq., C.R.S.)
and to provide the properties with an initial city zoning classifications of Residential
Estate (RE), Residential Low - 1 (RL-1) and Residential Medium - 2 (RM-2).
The Crestview East neighborhood is located in north Boulder between Violet Ave. to the
north, Fourmile Canyon Creek to the south, 19th Ave. to the west and 22nd St. to the east.
The neighborhood is considered an enclave as it is surrounded by the city's existing
boundary and is considered part of the North Boulder Subcommunity. A context map is
provided on the following page. Each of the lots is approximately an acre in size. The
total size of the area of annexation is approximately 15 acres (refer to Exhibit A of
Attachment A for a detailed annexation map).

Per state statutes, the purpose of the resolution (Attachment A) is to abandon September
1, 2009 as the date set for final action as established by resolution at City Council on July
21, 2009 and establish October 6, 2009 as the public hearing date for final action (or
second reading) of the annexation and initial zoning. The resolution also establishes that
the proposed annexation meets the state statutes for annexation.
First reading of the ordinance is scheduled for September 15, 2009 (to allow additional
time to complete negotiations with the neighborhood and to identify funding sources).
First reading of the ordinance will introduce a motion to publish the title of the ordinance
to annex and zone the properties Residential Estate (RE), Residential Low - 1 (RL-1) and
Residential Medium - 2 (RM-2). The City Council may make a motion to approve or
deny the first reading of the ordinance for annexation and initial zoning. Additionally, the
annexation agreement (which includes the tenns of annexation) will be presented to
council at first reading for review.
The state statutes require that the hearing for final action (or second reading) be held not
less than thirty days nor more than sixty days after the effective date of the subject
resolution setting the hearing date for final action.
AGENDA ITEM 3
Second reading of the ordinance, proposed for October 6, 2009 is considered the final
action in the annexation and initial zoning process. At second reading, the City Council
may approve the second reading ordinance as well as the annexation agreement with or
without conditions, or deny the second reading ordinance and the annexation agreement
entirely.
STAFF RECOMMENDATIONS:
Staff recommends approval of the proposed resolution finding the annexation petition in
compliance with state statutes and establishing October 6, 2009 as the date for council
action on the annexation ordinance.

STATUTORY ANNEXATION REQUIREMENTS.
WHEREAS, the City Council of the City of Boulder, Colorado, hereby finds that the Petition
to Annex the property more particularly described in Exhibit A, attached hereto and incorporated
herein by reference, is in compliance with subsection 31-12-107(1), C.R.S., as amended;
WHEREAS, the City Council of the City of Boulder, Colorado, finds that the following
requirements have been met:
a. Landowners of more than fifty percent of the area, excluding public streets and
alleys, meeting the requirements of Sections 31-12-104 and 31-12-105, C.R.S., as
amended, have petitioned the City of Boulder for annexation of such territory;
b. The Petition has been filed with the City Clerk;
C. The Petition alleges it is desirable and necessary that such area be annexed to the City
of Boulder;
d. The Petition alleges that the requirements of Sections 31-12-104 and 31-12-105,
C.R.S., as amended, exist or have been met;
e. The Petition contains a request that the City of Boulder approve the annexation of the
area proposed to be annexed;
f. The Petition alleges that signers of the Petition comprise the landowners of more than
fifty percent of the territory included in the area proposed to be annexed, exclusive of
streets and alleys;
g. The Petition contains signatures of such landowners;
h. The Petition contains the mailing address of each signer;
i. The Petition contains the legal description of the land owned by eaelY signer;
j. The Petition contains the date of signing of each signature;

k. The Petition contains the affidavit of each circulator of such Petition, that each
signature therein is the signature of the person whose name it purports to be; and
WHEREAS, four copies of an annexation map accompanied the Petition and contained the
following information:
a. A written legal description of the boundaries of the area proposed to be annexed;
S. A snap showing the boundary of the area proposed to be annexed;
C. Within the annexation boundary snap, a showing of the location of each ownership
tract in unplatted land and, if part or all of the area is platted, the boundaries and the
plat numbers of plots or of lots and blocks;
d. A drawing of the contiguous boundary of the City of Boulder next to the boundary of
the area proposed to be annexed and the contiguous boundary of any other
municipality abutting the area proposed to be annexed.
WHEREAS, all signatures on the Petition have been dated no more than one hundred eighty
days prior to the date of filing the Petition with the City Clerk;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BOULDER, COLORADO, THAT:
A hearing will be held to determine whether the requirements delineated in Sections
31-12-104 and 31-12-105, C.R.S., as amended, have been met and whether an election is required
under subsection 31-12-107(2), C.R.S. The hearing will be held at 6 p.m. on October 6, 2009, at
1777 Broadway, Boulder, Colorado.
